Real Estate Service Agreement

By ordering services from Photography by Cody Shoaf you agree to the following Service Agreement for Digital Imagery and Video. We hope these policies are informative and helpful as we create beautiful media for your marketing.

Limited Licensing Release:

In order to provide the best possible service at the best possible price, we do not sell our photographs. We license the use of our photographs.The price we quote is entirely dependent on (1) payment of the invoice in full, (2) using the photographs only as indicated, and (3) protecting them with proper copyright notification.

This service agreement is a limited liability photo release.

Imagery delivered is licensed to the “licensee” for:

-The purpose of listing a property only.

-Term of the listing, not to exceed one year.

Only the “licensee” has permission to use the delivered images on any electronic or printed form of advertisement for the promotion of the property.

Builders, stagers, designers, or “third parties” that wish to use images must contact the photographer directly for licensing and fees. In addition to payment a property release must be obtained from the homeowner by that third party.

For image integrity and quality control, we ask that images not be altered once delivered. Image editing will be done professionally by Photography by Cody Shoaf.

Please contact us for an additional release for any/all printed publications. Fees may apply.

Photo credit must be given to “Photography by Cody Shoaf” when using the images on any and all Social Media websites.

Images can not and will not be made available to another agent who takes over an expired or withdrawn listing.

Unauthorized use of images is a copyright violation, and will result in termination of this contract.

Home sellers/buyers may only request a copy of the photos from the photographer directly.

Videography will remain active as long as you require. Not to exceed 1 year . Terms are the same as above.

The photographer who has taken an image is the copyright holder of the image.

Photography by Cody Shoaf retains all copyrights expressed and implied otherwise for all images taken.

Licensing may be obtained for various applications of images. Please contact us for further details.

Homeowner policy:

Home sellers and buyers may only request a copy of the photos from the original photographer. The photographs will be supplied in a “Home Owner Media Kit”. Additional fees and licenses will apply, please contact us for further details.

Shoot Requests:

To ensure the best results from your photos please be sure the home is ready prior to the scheduled shoot time. We work on a set schedule for each photo shoot. Time is money, both yours and mine.

It is the responsibility of the agent to ensure that the listing is prepared for the virtual tour to be produced at the arranged time.
For liability reasons, Photography by Cody Shoaf will not perform any cleaning, dusting, or moving of furniture.
The homeowner must ensure that the property is free of potential hazards to the photographer, prior to arrival.
We love pets, we have a few of our own, but that does not mean we want to have pets present for the photo shoot, unless previously disclosed and agreed upon. Please inform the photographer if there will be a pet present prior to arrival.
We typically do not take images inside closets or utility rooms, but that can be included at no extra fee. Please give the photographer notice before arrival.
Community amenities are not included in the Bronze package, but can be included for an additional fee. Please contact us prior to the photo shoot for additional information.

Cancellation/Postponement Policy:

We understand that a home may not be as ready as expected on occasion.

It is the responsibility of the agent to inform us as soon as possible for rescheduling.
Any reschedule request within 16 hours of the agreed time is subject to a 50% rescheduling fee.
A job may be cancelled once a photographer arrives, but there will be no refund, the invoice must still be paid in full.
Reschedule requests are subject to the photographer’s future availability.

Weather Policy:

In the event of bad weather, there will be no fee assessed for rescheduling. This is entirely at the agent’s discretion. If the agent wishes for us to proceed we will deliver the best images possible, if however the agent wishes to reschedule, that will be available free of charge. Furthermore, the availability of the photographer must be assessed when processing the reschedule request.

Payment Policy:

Payment is required upon delivery of the Photos and/or Video(s). The Limited Licensing Release is not valid until after payment has been received in full. Failure to pay for the images and/or video(s) will result in a copyright infringement. We will ask that you remove the media from any printed or electronic form of advertisement. Failure to stop after our request will result in legal action.
